These terms cover your use of Votably at votably.app. By creating a decision or voting in one, you agree to them. If you do not agree, please do not use the service.
What Votably is
Votably is a free tool for making group decisions. Someone creates a decision, shares a link, people vote, and a result is revealed. There are no accounts. Anyone holding a decision's link can take part, so share links only with people you want involved.
Not for official or high-stakes voting
This matters, so it is not buried. Votably identifies participants with a browser cookie, not verified identity. Someone can clear their cookies or use another device or browser and vote again. We do our best to discourage it, but we cannot prevent it.
Do not use Votably for elections, shareholder or board votes, union ballots, legally binding decisions, or anything else where a manipulated result would cause real harm. Treat results as the sense of a group, not an audited tally. Votably is provided for casual, low-stakes group decisions.
Your content
You keep ownership of the questions, options, and names you enter. By putting content into Votably, you give us permission to store, display, and share it as needed to run the service, including showing it to everyone with the decision link and rendering it into the preview image used when a link is shared into a chat.
You agree not to use Votably to:
- break the law, or promote illegal activity, violence, or harm to anyone;
- harass, bully, threaten, defame, or target a private individual;
- post other people's personal or confidential information without their permission;
- post malware, spam, or content that infringes someone else's rights;
- attack the service, including scraping, flooding, circumventing rate limits, or attempting to access decisions you were not given a link to.
We may remove content or close a decision that breaks these rules, and we may block access to the service. We do not routinely review content, and decisions are created by users, not by us.
Creators and participants
The person who creates a decision controls it: they set the options and rules, can remove options while the group is still building the list, decide when voting starts and ends, reveal the result, and can reopen voting. If you take part in someone else's decision, you are trusting them with that control.
Decisions expire
Decisions expire 30 days after they are created and stop being viewable at their link. Votably is not storage or a record-keeping system. If a result matters to you, save or screenshot it.
Availability and changes
Votably is free and offered as-is. We may change, suspend, or discontinue any part of it, including these terms, at any time. If we change these terms we will update the date at the top of this page.
No warranty
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that results will be accurate or free from manipulation.
Limitation of liability
To the fullest extent permitted by law, Votably and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to one hundred US dollars (USD 100). Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.
Indemnity
You agree to indemnify and hold harmless Votably and its operators from claims arising out of the content you submit or your misuse of the service.
Age
You must be at least 13 years old to use Votably (or the minimum age of digital consent where you live, if that is higher).
Where Votably is offered
Votably is operated from the United States and intended for users in the United States. We make no claim that it is appropriate or available elsewhere. If you use it from another country, you do so on your own initiative and are responsible for complying with your local laws.
Governing law
These terms are governed by the laws of the State of Oregon, United States, without regard to conflict-of-law rules. You and we agree that any dispute will be brought exclusively in the state or federal courts located in Oregon, and both of us consent to their jurisdiction.
